    • Iraq Contingency Contracts
    • Ball Janik LLP’s Government Contracts lawyers sued the United States Government in the Court of Federal Claims on behalf of the Laudes Corporation, which provided vital services to the coalition and Iraqi forces in 2003 and 2004 under undefinitized letter and fixed-price contingency contracts.  Despite fulfilling its obligations under difficult and often dangerous conditions, the client was paid less than half the money it was owed. As a result of our creative legal theories, Laudes ultimately recovered $11 million in payments from the U.S. Government.

    • Bid Protest Success – Computer Services
    • In a procurement for computer services, the source selection authority made an obvious error that prevented our client from receiving award of the contract.  We contacted the procuring agency and persuaded the agency to take immediate corrective action.

    • Clear AFS Radar Upgrade Project
    • On behalf of a subcontractor on a military radar facility, we sued the prime contractor under the Miller Act, resulting in a multi-million dollar recovery for the client.

    • Creative Solution Protects Award, Performance of Contracts
    • The Government Contracts practice designed a unique strategy to protect the award of two large construction contracts to our client, overcoming the bankruptcy of its parent company. Our client was then able to perform the contracts, worth more than $100 million, for which it was uniquely qualified but nearly ruled ineligible.

    • Government Contract Disputes
    • Matt Osborne has assisted the firm's clients in a variety of contract disputes, including wrongful termination claims, cumulative impact claims and Requests for Equitable dustment. 

    • Recovery of Claims for Increased Costs
    • The Government Contracts practice represented Alcan Electrical & Engineering, Inc. for increased costs it incurred as the electrical subcontractor on the $178 million Bassett Army Hospital on Fort Wainwright in Alaska. We designed and implemented a legal strategy that resulted in a recovery of more than $4 million for the client.

    • Recovery for Impairment of Suretyship
    • The Government Contracts practice sued the United States on behalf of a surety who stepped in and performed in place of a defaulted prime contractor, securing a $1.7 million judgment for our client.
